The APR Stage III Raffle OFFICIAL RULES
"The APR Stage III Raffle" ("Raffle") starts at 12:00:01 p.m. (PST) on November 21, 2011 and ends at 11:59:59 a.m. (PST) on December 31, 2011 for automatic entry and on December 25, 2011 for the postmarking of a mail-in entry (collectively the "Entry Period"). The sponsor of this Raffle is APR, LLC, 4800 US Hwy 280 W, Opelika, AL 36801, (the "Sponsor"). The Raffle shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
ELIGIBILITY: NO PURCHASE IS NECESSARY TO ENTER OR WIN. You must be a legal resident of the United States of America (exclusive Puerto Rico and all U.S territories and possessions which are not eligible) and be eighteen (18) years of age or older at the time of entry to win. Employees of APR, LLC and their respective parent, subsidiary or affiliated companies, advertising, promotion, and fulfillment agencies, and the immediate families of each and those living in the household of same are ineligible to participate in this Raffle. All applicable federal, state and local laws and regulations apply. Raffle is void in Puerto Rico and all U.S. territories and possessions and wherever prohibited or restricted by law.
HOW TO ENTER:
HOW TO AUTOMATICALLY ENTER ONLINE: To enter on-line visit www.goAPR.com during the Entry Period, and click on "Buy Now" of any product. Complete a purchase transaction of equal to or more than $1000USD. Entries must be received by 11:59:59 p.m. PST on December 31, 2011. Sponsor is not responsible for technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a participant's ability to take part in the drawing. In addition, Sponsor shall not be responsible for any damage to any computer or other property resulting from participating in, or downloading any materials for, this drawing.
HOW TO ENTER BY FACEBOOK: To enter visit the APR, LLC. facebook page and enter the "APR Stage 3 Raffle". All Facebook Entries must be registered by December 25, 2011. One entry is allowed per person (with a valid e-mail address) regardless of entry method used, and any subsequent entries will not be eligible. Entries which are late, lost, stolen, mutilated, tampered with, illegible, incomplete, mechanically reproduced, inaccurate, forged, irregular in any way or otherwise not in compliance with these Official Rules will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned.
HOW TO ENTER BY MAIL: To enter by Mail, on a 3" x 5" card handprint your first and last name, street address, city, state, zip code, phone number with area code, birth date and email address. Mail your completed entry to APR, LLC. ATTN Rebecca Hagen, 4800 US HWY 280 W, Opelika, AL 36801. All Mail-in Entries must be postmarked by December 25, 2010 and received by December 31, 2011. One entry is allowed per person (with a valid e-mail address) regardless of entry method used, and any subsequent entries will not be eligible. Entries which are late, lost, stolen, mutilated, tampered with, illegible, incomplete, mechanically reproduced, inaccurate, postage due, forged, irregular in any way or otherwise not in compliance with these Official Rules will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned.
WINNER SELECTION: There will be a total of one (1) winner determined by a random drawing from all eligible entries received to be held on or about January 6, 2011 by representatives of Sponsor. In the event the potential winners do not qualify or are not willing to accept the prize, there will be an alternate winner drawing from among eligible entries. All decisions of Sponsor are final and binding. Odds of winning depend upon the number of eligible entries received and are equal regardless of method of entry.
PRIZE: One (1) Prize will be awarded. The winners will receive one APR Stage III Turbocharger System of their choice up to $5000USD in Retail Value. No substitution or cash equivalent of prizes granted except at Sponsor's sole option of a prize of comparable or greater value. No prize transfers permitted. PRIZES ARE AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND EXPRESSED OR IMPLIED.
NOTIFICATION OF WINNER: The potential prize winner will be notified by email or telephone. If the potential prize winner cannot be reached within five (5) business days (i.e. Monday thru Friday excluding any United States holidays), another eligible entry will be drawn and another potential prize winner will be notified. Subsequent eligible entries will be drawn as provided for above until an eligible prize winner is reached and such eligible prize winner has submitted and returned all necessary documents as provided for herein. Each winner must show valid state issued driver's license or other identification as evidence of identity. All federal, state, and local taxes are the prizewinner's sole responsibility.
AFFIDAVIT OF ELIGIBILITY, LIABILITY RELEASE AND PUBLICITY RELEASE: Each prizewinner will be required to complete, execute and send back to the APR, LLC an affidavit of eligibility, a liability release, an IRS W-9 form and (except where prohibited) a publicity release within fourteen (14) days of issuance or an alternate winner may be selected. This affidavit will be sent out to the potential winner by UPS 2 day delivery, which will include the affidavit and a postage paid envelope to send back the affidavit. Upon receiving and approving the required documents, the prize certificate will then be sent to the winner. Failure to comply with these rules will cause the prize to be forfeited.
TERMS AND CONDITIONS: BY ENTERING THIS RAFFLE, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS APR, LLC, ITS PARENT, SUBSIDIARY AND AFFILIATED COMPANIES AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS, ADVERTISING AND PROMOTION AGENCIES, CONSULTANTS AND ANY OTHER COMPANIES PARTICIPATING IN THE PROMOTION, ADMINISTRATION OR FULFILLMENT OF THIS RAFFLE (COLLECTIVELY THE "RELEASEES") FROM ANY AND ALL LIABILITY, CLAIMS, LOSS, DAMAGE TO PERSONS OR PROPERTY, COSTS, EXPENSES AND ACTIONS OF ANY KIND RELATED TO OR ARISING OUT OF THIS PROMOTION OR RESULTING FROM THE ACCEPTANCE OR USE OF ANY OF THE PRIZES AWARDED, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, INVASION OF THE RIGHT OF PRIVACY OR PUBLICITY.
LIMITATIONS ON LIABILITY: Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsors' sole control.
GENERAL: Entrants release and waive any claims they may have against Releasees for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of any prize or element thereof, or participation in this Raffle.
If for any reason this Raffle is not capable of running as planned, or if this Raffle or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Raffle and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors' sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Raffle, the Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Raffle or any portion thereof. In the event this Raffle is cancelled, the Sponsors will conduct a random drawing to award all prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If a dispute arises about who submitted an entry on the Entry Site, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.
NOTE: Internet entry must be made by the entrant, only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial Raffle subscription notification and/or entering service sites, will be declared invalid and disqualified for this Raffle. The use of any device to automate the entry process is prohibited.
